FLAX MILL HOLIDAY LETTING AGREEMENT – FULL TERMS AND CONDITIONS

These Terms and Conditions explain what you agree to when you book the property and tell you what to expect from me; they are designed with fairness and safety in mind.

The guests will be entitled to occupy the property for holiday purposes only and this agreement shall not confer on the guest any security tenure within the terms of Housing Act 1988 pursuant to which the occupation shall be deemed to be by way of an excluded tenancy.

The person who makes the booking and is named on the booking is deemed to be the “responsible person” and must be at least 21 years of age and be one of the guests staying at the cottage. As the person who has contracted to the booking, they will also be responsible for the actions of the other holiday makers, settling of payments, and the primary contact if necessary for any other matters related to the booking.

The holiday let booking is personal to the person who is named on the booking, and cannot be transferred to another person without my permission, nor can the accommodation be sub-let to another party for the whole or part duration of the stay. Furthermore, the property cannot be used for commercial purposes, trading or financial gain of any type during the booking.

 

Additional Provisions:

  1. The property is not suitable for wheelchairs and those with limited mobility due to its general access both externally and internally
  2. The property is not to be used for Stag or Hen parties, or any other parties
  3. No smoking including e-cigarettes, vapes etc. No drugs
  4. One small dog allowed. Please see further information below

 

Recent additional Fire and Safety requirements:

  1. There are no facilities for charging electric vehicles onsite. Extension leads must not be used for this purpose.
  2. Charging of electric bikes, scooters, portable heaters or similar devices within the cottage is forbidden.
  3. Guest owned electrical equipment should not be switched on and left unattended at any time.
  4. The use of candles, tea lights and any similar products is strictly forbidden.

 

Covid-19 Policies

Self-Isolation – the cottage is NOT a suitable place for self-isolation.

If you or a member of your party develops symptoms, the government guidance is that you should check out and return home to self-isolate. 

DO NOT COME IF YOU OR SOMEONE YOU LIVE WITH, HAS SYMPTOMS, OR IF YOU HAVE BEEN EXPOSED TO SOMEONE WITH COVID-19 IN THE 10 DAYS BEFORE YOUR HOLIDAY.


Terms of use

  • To keep the interior of the property in a good clean condition and not damage the property or its contents
  • Hand the property back in the same clean condition it was in at the beginning of the term. Reasonable wear and tear and damage by insured risks accepted. 
  • Report any breakages or damage within the agreed occupancy. I acknowledge that accidents do happen, but notification before your departure enables me to take any remedial action necessary for incoming guests.
  • Please remember to empty the dishwasher and put crockery and cutlery away. 

If you are able to do the following, that would be very much appreciated too!

  • Empty bins
  • Strip the beds if time allows


Size of party

  • My insurance limits me to having up to four people (adults and children) staying in the cottage at any one time. If more than four people stay in the cottage, your booking may be cancelled and you may be asked to leave with no refund made.

Problems or complaints

  • Please tell me straight away about any problems. I want you and our future guests to have as lovely a time as possible, and I work hard to put anything right immediately. In an emergency, please contact Helen Charlesworth on 07791 216330 or flaxmillcottage28@icloud.com.
    I cannot consider compensation for complaints raised after you leave or if you won’t let me try to put things right while you are with me.


Noise

  • Please be respectful of immediate neighbours and other residents in the Mill. Many neighbours are permanent residents and I rely on my guests respecting the peaceful and quiet environment within the property to continue my business.
    Noise disturbance of other occupiers within the building and complaints thereof may result is loss of security deposit.

Security

  • Please lock the property and close the downstairs windows whenever you go out.
    I cannot be held responsible for any accidents, break-ins or theft during your stay, caused by the above.

Limitation of liability

  • I cannot accept liability for any injury, loss or damage, consequential or otherwise suffered by you or any other member of your party, unless there was wilful default by me, or unless personal injury or death was caused by my negligence.

First Aid & Fire procedure

  • There is a first aid kit, fire blanket and fire extinguisher on the ground floor, with a second fire extinguisher located on the top floor in case of emergency.
    However, Please DO NOT attempt to tackle a fire unless you feel confident to do so. The primary goal is for guests to vacate the property, telephone the fire services on 999 and then contact myself, the owner, Helen Charlesworth on 07791 216330.

Keys

  • You will receive one set of keys for the property which will be left in the key safe by the front door.  The code will be issued ahead of your arrival.
    Standard arrival times are from 4pm however please don't hesitate to contact me if your requirements differ, as I aim to be able to accommodate where possible.
    Check-out time is 10am prompt to enable adequate cleaning time.

Right of Entry

  • I reserve the right of entry to the property at all reasonable times for the purposes of inspection, or to carry out essential repairs, cleaning and maintenance.


Dogs

I welcome one small/medium sized dog.

In order to ensure a pleasant stay and for the well-being of future guests, I ask that you please note the following house rules: 

  • While the property is dog friendly, it is not specifically equipped to cater for our four-legged friends, so please bring your dog’s own bed, blanket, bowls, towels. 
  • I prefer that your dog remains on the ground floor and does not sit on the furniture, but recognise that habits at home may be different. Please bring throws etc to cover up the furniture if so. 
  • If your dog is used to sleeping on beds, please advise in advance and bring your own bedlinen. It may be advisable to keep the bedroom doors closed when not in use. A stair-gate and crate are provided if needed.
  • Dog waste should be bagged and binned in the large bin store at the top of the site. (Door code can be found by the kitchen bins in the cottage.) A charge may be made for any waste that is not picked up.
  • Please do not leave your dog in the house alone at any time.  It is not fair on the dog, nor the neighbours. In unfamiliar surroundings, dogs can become stressed - even those who are usually calm - leading to the potential for excessive barking, destructive behaviour and noise disturbance.

Noise disturbance and complaints thereof, or damage/extra cleaning resulting from any of the above, may result in the loss of the security deposit.


Cancellations

Cancellation fees are as follows:
More than 6 weeks before arrival: Your deposit and any balance already paid is refundable, minus £100 admin fee.
4-6 weeks before arrival: 50% of the full amount is refundable.
Less than 4 weeks: I am unable to provide a refund unless the property is re-let.
I strongly advise obtaining your own holiday insurance to cover the above eventuality.

 


Disclosure

Failure to disclose all relevant information or comply with these terms may lead to termination of the contract and loss of booking without a refund.
